BSJZ Law Client Prevails in Arbitration

In January 2015, an earth and utilities subcontractor was terminated for allegedly over-billing and failing to perform its work on the construction of a large mixed-use development in Birmingham, Michigan. The dispute centered on an interpretation of the payment terms of the subcontract and whether the subcontractor timely and adequately performed its work. The arbitrator awarded the subcontractor its contract balance, denied the general contractor’s counterclaim of nearly $200,000, and awarded the subcontractor reasonable attorney fees as a prevailing party. Ryan W. Jezdimir was counsel for the subcontractor.
